In this comprehensive assignment, you are required to demonstrate fluency in juvenile justice system stages and processes in a fictitious simulation while applying discretionary variables. Based upon a youth case study, you will apply course concepts to determine the best course of action at each of the juvenile justice decision points beginning with police discretion and ending with juvenile disposition. You will explain your decision at each point as you move the fictitious youth from one stage of the system to the next. Identify and apply legal decisions and the youth’s rights when appropriate. Utilize your system flow-chart to confirm that you have addressed all decisions points and applied all variables. Please make sure to utilize course readings, resources, and discussions at every stage. The assignment requires approximately four hours and should be five to six pages. Keep in mind that it is your analysis, not conclusions that are most important as an assessment of your skills and abilities.
LaChe is a sixteen-year-old runaway from Columbus, Ohio. Prior to running away, she spent one year in a juvenile institution for felonious assault. She stabbed her father during a fight. She claimed he abused her. It was her first offense. A store owner claims LaChe pulled out a knife and threatened to kill him if he did not give her the money in his cash register. When he said “no,” she got scared and ran. He called police, and they have detained her. She was hiding in an alley around the corner from the store. She did not have a knife and claims she just pretended to have a weapon.
Please address each decision making point and explain what you think should happen to LaChe based upon course concepts and materials and best-practices. Begin with the police applying discretionary criteria, detention criteria, intake, diversion options, plea bargaining, adjudication and disposition. Include legal criteria and the rights that LaChe should have at each stage. Also consider whether LaChe should be bound over and tried in the adult criminal court. If diverted, what type of program would best serve LaChe? Is she even likely to get diverted? What types of treatment should she receive and at what stage? Even if you determine that LaChe will not go through the entire system because you divert her, she plea bargains, her charges are dismissed or she is found not guilty, continue to move her through the system to disposition. Identify every decision making point such as police detection and discretion, detention, diversion, transfer, and sentencing, applying the applicable course concepts.
