Directions
Using the deposition transcript associated file, prepare two separate documents: (1) a Deposition Index; (2) a Deposition Summary (note that these terms are different from the terms in the text). Choose your own topic headings but keep them to a minimum and as concise as possible (i.e., “Background” and “Before collision”).
Background
Accompanying this assignment is a “Depo Excerpt” from a deposition transcript. This is from a case that I litigated in which the plaintiff (the deponent) claims that the defendant (my client) car rear-ended the plaintiff’s car while at a stop at a traffic light, causing her injuries. Defendant alleges that she stopped her car behind plaintiff’s car at the red light, and that plaintiff then backed up, hitting defendant’s car. You will probably notice that the deposition was taken with the assistance of an interpreter. Assume that you represent the defendant. I provided a description of the indexing and summarizing of depositions in the introductory materials of this week’s class.
