The Framer’s of the Bill-of-Rights believed that the set of suspect’s right’s and the defendant’s rights that are included in the constitution were critical for getting at the truth behind a criminal accusation (e.g., the 4th, 5th, and 6th Amendment rights). How so? How do these rights reduce the likelihood that the government convicts an innocent person?
LEARNING OUTCOMES: Explain who, in general, is protected by the aforementioned rights. Are they in the constitutional just to protect the guilty? Focus on how the respective rights create a barrier (if imperfect) to sending innocent people to prison or to a death chamber. To help you get started, think about the Spanish inquisition which gave suspects (of heresy) none of the rights mentioned above. Do you think the inquisitors convicted and punished innocent people? Were some of the witches put to death in Salem centuries ago were innocent? How would suspect rights affect the outcome of trials (and, again, we see that structure affects process, which affects outcome).
